Testimonial Release Agreement

I hereby grant permission to Rullingnet Corporation Ltd., creators of VINCI, the ongoing use of my Testimonial. This Testimonial may be used for:
- Direct mail campaigns sent to Rullingnet’s customers and prospects
- Various print and online advertisements and promotions
- Magazine inserts
- Promotions on the Rullingnet’s website (www.vincigenius.com) or email campaigns
- Promotions on Rullingnet’s social media channels, such as Facebook, Twitter and Pinterest
- On-site promotions and advertisements at Rullingnet organizational events and those of its affiliate partners
By providing and submitting your information to the Customer Testimonial section located at www.vincigenius.com/en/testimonials on the www.vincigenius.com website, you agree to enter into the Customer Testimonial Release Agreement as of the date and year set forth upon submission of the online form.
WAIVER
I irrevocably waive all rights and release Rullingnet Corporation from, and shall neither sue nor bring any proceeding against any such parties for any claim, whether now known or unknown, for any right based upon or relating to the use and utilization of the Testimonial. There shall be no obligation to utilize this authorization.
AUTHORIZATION & RELEASE INFORMATION
The Customer understands that his/her Testimonial as outlined above made on behalf of the Rullingnet Corporation may be used in connection with publicizing and promoting the Rullingnet Corporation and all its products. The Customer authorizes the Rullingnet Corporation to use the Customer’s name, brief biographical information, other provided details, and the Testimonial as defined in this Agreement.
The Customer hereby irrevocably authorizes the Rullingnet Corporation to copy, exhibit, publish or distribute the Testimonial for purposes of publicizing the Rullingnet Corporation’s programs or for any other lawful purpose. The Testimonial may be used in printed publications, multimedia presentations, on websites, or in any other distribution media. The Customer hereby agrees that the Customer will make no monetary or other claim against the Rullingnet Corporation for the use of the Testimonial.
In addition, the Customer waives any right to inspect or approve the finished product, including written copy, wherein the Customer’s likeness or the Testimonial appears.
The Customer hereby holds harmless and releases the Rullingnet Corporation from all claims, demands, and causes of action which the Customer, the Customer’s heirs, representatives, executors, administrators or any other persons acting on the Customer’s behalf or on the behalf of the Customer’s estate have or may have by reason of this authorization.
I represent and warrant to Rullingnet Corporation that: (i) I have the power and authority to enter into this Agreement and to perform its obligations; and (ii) the Testimonial or any related materials will not violate the rights of any third party and will not give rise to any claim of violation of any right based upon or relating to the use of the Testimonial. I indemnify and hold harmless Rullingnet Corporation from any damage or cost (including attorneys' fees), arising out of the use or distribution of the Testimonial.
This Agreement is executed voluntarily and without any duress or undue influence. The Customer acknowledges that he/she has read this Agreement and executed it with his/her full and free consent.
By submitting a Testimonial, you are agreeing to these terms. Please note that these terms may be updated in the future.
